This action was brought for the recovery of the sum of $4,-585.50 and attorneys’ fees, and costs.

Plaintiffs allege that, on the 6th day of April, 1920, they were indebted to defendant in the sum of $23,500, a balance due on seven promissory notes; that defendant agreed to extend payment of said balance, conditioned that plaintiffs execute five notes, four for $5,000 each and one for $3,500, all bearing 10 per cent, interest and due May 6, 1920, payable to one Paul R. Warner; that plaintiffs were not indebted to Warner, but executed the notes to him at the request of defendant,…
