CLEVENGER, Circuit Judge.
Plaintiff Helfgott & Karas, P.C. appeals the dismissal of its claims by the United States District Court for the Southern District of New York. See Helfgott & Karas v. Lehman, 47 F.Supp.2d 425 (S.D.N.Y.1998). At issue is the refusal of the Commissioner of the Patent and Trademark Office 1 to reinstate international prosecution of a patent application filed under the auspices of the Patent Cooperation Treaty.
