Defendant, Scoular-Bishop Grain Co. (ScoularBishop), appeals the directed verdict in favor of the plaintiff, Five Points Bank (bank), in an action for conversion involving the sale of grain. At the conclusion of all the evidence the district court granted the bank’s motion for directed verdict, entered a judgment for the bank in the sum of $9,100, and discharged the jury.
The bank brought suit against Scoular-Bishop for grain purchased from Duane Stevenson subject to a recorded security interest in favor of the bank. In May 1981 Stevenson, who had a marginal operation, had pledged certain…
