The plaintiff, William T. Hoban, was discharged from his position as captain of police with the Chicago police department following a hearing before the defendant police board on charges relating to his alleged failure to live within the city of Chicago as required by the Chicago Municipal Code. (Municipal Code of Chicago, ch. 25, par. 30.) Plaintiff sought review under the Administrative Review Act (Ill. Rev.
