MEMORANDUM OPINION

JOHNSON, District Judge

This cause came on to be heard on the plaintiffs petition for emergency relief freezing the assets of defendant Richard M. Scrushy (doc. 2). The plaintiff Securities and Exchange Commission (“SEC”) was present by and through its counsel of record, defendant Scrushy was present in person and through his counsel of record, and defendant HealthSouth Corporation (“HealthSouth”) was present through its counsel of record. 1 The hearing commenced on April 9, 2003 and continued for 11 days, during which the court heard testimony and received evidence.
