MEMORANDUM OPINION

GLEN M. WILLIAMS, District Judge.

Plaintiffs, Terry Fuller and United Coal Company, have brought this suit under 42 U.S.C. § 1983, alleging violations of plaintiff Fuller’s constitutional rights through the operation of Virginia’s attachment statute. Specifically, plaintiffs state that Fuller’s right to procedural due process under the Fifth and Fourteenth Amendments to the United States Constitution has been violated. In addition, they argue that Virginia’s attachment statute 1 violates 15 U.S.C. § 1673 2 and is therefore void under Article VI, cl. 2 of the United States…
