This matter is before the Court On Defendant’s partial motion to dismiss, (Dkt. No. 12). For the reasons stated below, the motion is GRANTED IN PART AND DENIED IN PART.

I. FACTS 1

Defendant operates a resort on Kiawah Island, South Carolina. (Dkt. No. 1 at ¶ 17). Defendant applied for temporary labor certifications with the U.S. Department of Labor'(DOL) to employ foreign workers at. its resort in 2012, 2013, and 2014. (Id. at ¶22).
