*988In an action to recover damages for personal injuries, the defendant John Scully appeals from so much of an order of the Supreme Court, Suffolk County (Tanenbaum, j), dated April 1, 2009, as denied that branch of his cross motion which was for summary judgment dismissing the causes of action alleging violations of Labor Law § 240 (1) and § 241 (6) insofar as asserted against him and granted that branch of the plaintiffs cross motion which was for summary judgment on the issue of that defendant’s liability on the cause of action alleging a violation of Labor Law § 240 (1).
