We recently had occasion in Ortega v Puccia (57 AD3d 54 [2d Dept 2008]) to discuss the legal standard governing Labor Law § 200 when a plaintiff is injured at a work site because of dangerous or defective equipment provided by, the plaintiff’s own employer.
