Separate judgments have been entered in favor of the towns of Lancaster and Cheektowaga dismissing plaintiff’s complaint on the merits. An order has also been entered denying plaintiff’s motion for a new trial. The appeals herein are from these judgments and order.
The complaint alleges that on the 23d day of August, 1930, there existed at the intersection of Genesee street and Transit road an automatic electric traffic signal suspended about twenty feet above the surface of the road, which had been erected and maintained at the joint expense of the two towns; that it was the duty of the said…
