Prom an award for an occupationally related pulmonary disablement by the hearing referee, defendant appealed to the Workmen’s Compensation Appeal Board. The appeal board, reversing the referee’s award, held that plaintiff failed ,to comply with notice provisions of the Workmen’s Compensation Act. The Court of Appeals affirmed and further held that denial of an opportunity for oral argument before a reconstituted membership of the appeal hoard did not deny plaintiff due process of law. 14 Mich App 31. Application for leave to appeal was granted by this Court on March 19, 1969. 381 Mich 809.
