MEMORANDUM
WISEMAN, District Judge.
This is an action for damages for the death of plaintiff’s decedent against, among others, Union Carbide, the owner of the premises where plaintiff’s decedent was working when he died. Union Carbide has moved for summary judgment on three grounds: (1) tort recovery against Union Carbide is barred by Tenn.Code Ann. § 50-915 because Union Carbide was the principal contractor for the project; (2) Union Carbide did not fail to provide a safe work place; and (3) Union Carbide did not have a duty to see that adequate safety precautions were taken.
