The plaintiff was a railway postal clerk on one of the trains of the defendant, and in his complaint he alleges that while engaged in his work in the railway oar assigned to Mm for bis use the train was stopped at a water tank and then started very suddenly and with an unusual jerk, so that he was thrown violently to the floor of the car and severely hurt. The defendant denied these allegations, and alleged that if the train was suddenly started with a jerk the plaintiff’s fall was not caused thereby, and if it was so caused the plaintiff negligently contributed to his own injury, in that,…
