after stating the case: The defendant assigned as error that, at the beginning of the trial, he Avas under bond in the sum of $'7,000, the State not insisting on a conviction for murder in the first degree, and that, during the trial, the ’ Court ordered him into custody and refused to bail him, when he was not- indicted for a capital felony. It appears from the facts found by the Court with regard to this exception, that the defendant was ordered into custody and no request was made at the time for bail.
