This is an action for infringement of United States Letters Patent, No. 1,820,-624, brought by the plaintiff, the assignee of Victor V. Kunkel, to whom Letters Patent were issued on August 25, 1931. At a pre-trial hearing the issues were limited to claimed infringements of claims No. 1, No. 5 and No. 6 of the patent in suit, and claim of defendant that plaintiff’s patent is not valid in that alleged inventions set forth in claims 1, 5 and 6 have been patented and described in printed publications prior to the supposed invention.
