MEMORANDUM
This action, filed on December 7, 1970, seeks judgment for plaintiff United States of America (“the Government”) on two mortgages and notes, and foreclosure of the property pledged thereunder. The only non-defaulting defendant, Skellyway Construction Co., Inc. *93(“Skellyway”) has asserted the priority of its mechanic’s lien. The peculiarity of the case is that the Government, besides being the foreclosing mortgagee, is also the apparent owner of the fee interest in the proprty.
