Appeal by the plaintiff, John T. Eagan, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Hew York on the 6th day of January, 1908, upon the decision of the court rendered after a trial at the Hew York Trial Term, a jury having been waived, dismissing the complaint.

-This is an action upon a bond given for money loaned which was secured by a mortgage on real estate in the county of Kings. The *744bond and mortgage w.ere executed by the defendant’s testator to plaintiff on the 2d day of December, 1892. On the 21st day of March, 1898, the obligor and mortgagor, who was then the owner of the equity of redemption in the mortgaged premises, conveyed the same to plaintiff who then owned the bond and mortgage.
