This case is before the court on the parties’ cross-motions for summary judgment. For the reasons stated below, the court grants defendant’s cross-motion, and denies plaintiff’s motion.

FACTS

Plaintiff, Nebco & Associates, is a Nebraska partnership that buys, sells, and rents real estate. Nebco was interested in purchasing a restaurant known as March-ios’ Italian Cafe from the United States, acting through the Small Business Association (SBA).
