The Athens Trust and Banking Company failed, and, in consequence, a number of indictments were returned by the grand jury of Clarke county against.Griffin, the-‘president, and Mc-Crary, the. cashier. One of the indictments charged a violation of section 205 of the Penal Code, in that the defendants accepted a deposit of'ÍSSl.lO, knowing at the time that the bank was insolvent, and failed to pay it to the depositor on demand.
