Baldwin, J. concurring.

On the 22d of September, 1857, the parties to this action intermarried, and until the tenth of the following February they lived *93together as husband and wife. On this last day, four months and nineteen days from the date of the marriage, the defendant gave birth to a fully developed child. The plaintiff insists that this child was begotten by a stranger; that the defendant knew, or had sufficient reason to believe that she was with child at the date of her marriage, and concealed the fact from him; that be was ignorant of her condition, and believed her at the time to…
