Plaintiff Jonel Barbu (“plaintiff’) brings this action under the Employee Retirement Income Security Act of 1974 (“ERISA”), challenging the termination of his long-term disability benefits, which were paid for approximately 17 months until defendant Life Insurance Company of North America (“defendant” or “LINA”) determined that plaintiff was no longer disabled. Athough both parties moved for summary judgment, they have since stipulated that the Court should conduct a “bench trial on the papers” based on their summary judgment submissions.…
