Plaintiff Charles L. DeCesare (“Plaintiff’ or “DeCesare”) brings this Action against Defendants The Aetna Life Insurance Company (“Aetna”) and The Dress Bam Long Term Disability Plan (the “Plan”) (collectively “Defendants”) for violations of § 502(a)(1)(B) of the Employee Retirement Income Security Act of 1974 (“ERISA”), 29 U.S.C. § 1132(a)(1)(B), alleging that Defendants improperly discontinued Plaintiffs disability benefits under the Plan based on a determination that Plaintiff was no longer totally disabled.
