Following a three-day trial, judgment was entered in favor of Versatile Helicopters, Inc., and against the City of Columbus, Ohio, for breach of contract in connection with the purchase of a used police helicopter through Air Flite, Inc., a third-party broker engaged by the City to market the helicopter for sale. The City appeals from the denial of its motion for judgment as a matter of law, Fed.R.Civ.P. 50, maintaining that it could not be held liable because it was not a party to the purchase agreement.
