In this Administrative Procedure Act (“APA”)1 case, plaintiff Angiqtech Pharmaceuticals Inc., the exclusive licensee of U.S. Patent No. 5,811,447 (“the ’447 patent”) and the agent of the ’447 patent’s owner for purposes of this action, challenges the United States Patent and Trademark Office’s (“PTO”)2 final decision denying a patent term extension for the ’447 patent.
