On the 9th day of June, 1911, R. A. Metcalf was arrested, charged with selling intoxicating liquors, and on said day he executed an appearance bond in the sum of $500.00 with C. A. Greene and E. C. Shermán as sureties, which bond was approved by the court. The case was set for hearing and on the day set for trial the defendant failed to appear according to the terms and conditions of the recognizance; the court under section 7112, Comp. Laws 1909 (section 6110, Rev. Laws 1910), declared the recognizance forfeited and ordered suit brought upon the bond. On the same…
