GANEY, District Judge.

This is a motion to vacate a judgment entered on a directed verdict on behalf of the defendant at the close of all of the evidence in the case and to enter a judgment on behalf of the plaintiff and to order a retrial limited to the question of damages.

The plaintiff on November 9, 1943 was a longshoreman in the employ of B. H. Sobelman Company, a stevedoring contractor, who together with eight other men comprised a gang of nine who were ordered to report on board the vessel, George Read, lying at Richmond, Pier G. in the City of Philadelphia.
