Reversing.

The above three cases were tried together below, all being suits seeking damages of appellant on account of injury by the overflow of water on their properties. Ap pellees Salyer and Bice sued for damages for injury to real estate; Hester sought damages for injury to personal property.

In his petition Bice and his wife alleged ownership of a house and lot in Johnson county, on the waters of Jennie’s creek. It was asserted that Big Sandy & Kentucky Biver Bailroad Company had “in the construction, operation and maintenance of their railroad,…
