Credit Suisse Securities (USA) LLC (“Credit Suisse”) 1 is a member of the Fi nancial Industry Regulatory Authority (FINRA), and Credit Suisse’s form “New Account Agreement” includes a clause requiring its customers to submit all disputes to FINRA arbitration. When, however, Credit Suisse lost a major FINRA arbitration against a customer, STMicroelectronics, N.V. (“ST”), Credit Suisse attacked the arbitrators for various improprieties and asked the district court and now this Court to undo the award.
