Taylor, Justice.

This appeal arises out of an action brought in the Court of Common Pleas for McCormick County for specific performance of a contract for the sale of timber and the damages which were alleged to have resulted from defendants’ failure to perform said contract. This Court ordered specific performance, White v. Felkel, 222 S. C. 313, 72 S. E. (2d) 531, and the case was thereafter docketed on Calendar 1 of the Court of Common Pleas for McCormick County with Respondent giving notice of intention to try the issues as to damages flowing from the defendants’ failure to perform.…
