This is an action for damages arising out of a liability insurance policy issued by defendant, Fidelity Casualty Company of New York, to plaintiff R.M. McCombs, on January 19, 1928, and renewed on January 19, 1929. By said policy the defendant company agreed to insure plaintiff R.M. McCombs in the sum of $5000 against liability imposed upon him by law for damages on account of bodily injury or death suffered by any person or persons as the result of an accident while the policy was in force, and caused by reason of the use, ownership, or maintenance of one 1926 model, six cylinder, Hupmobile…
