MEMORANDUM OF DECISION AND ORDER RE: CROSS-MOTIONS FOR PARTIAL SUMMARY JUDGMENT

By these cross-motions for partial summary judgment, the parties ask the Court to determine whether Turner Entertainment Co. (“Turner”), the successor in interest to Loew’s Incorporated (“Loew’s”), today enjoys the exclusive right to distribute the motion picture Gone with the Wind (the “Picture”) or whether it shares nonexclusive distribution rights with the heirs of David O.
