The plaintiff’s case is, that in 1868, he was the owner and in possession of a lot in Hastings, on the east side of and fronting on Bailly street, [a street ninety-nine feet wide] as well as of said street to its centre adjoining said lot, subject only to the easement of the public therein for a street, and that the defendant, without his consent, and without acquiring the right so to do by proceedings therefor pursuant to its charter, [Laws of 1857, ch. 39, s. 9,] appropriated part of said street to its use for the purpose of laying a railroad track upon it,…
