MEMORANDUM AND ORDER

Plaintiff has filed his amended complaint for declaratory judgment in this cause, which has been removed to this Court from the Superior Court of the State of Alaska upon diversity of citizenship.
This action arises from an automobile accident involving plaintiff, Lyle R. Kackman, and one Charles E. Phillips. Plaintiff contends that the accident was the result of Phillips rounding a curve on the wrong side of the highway, Phillips thus causing his vehicle to collide with the one being operated by plaintiff.
