Appellant CenterPoint Energy (Center-Point) challenges the district court’s grant of summary judgment to respondent State Bank of Delano (State Bank) and respondent Swartz Brothers Associates, Inc. (Swartz), arguing that the district court erred by determining that Swartz is not required to pay the utility debts incurred by respondent Kensington Equity Partners, Inc. (Kensington) before Swartz’s appointment as the receiver of property that Kensington formerly owned and operated.
