Appeal from a judgment and from an order denying plaintiff’s motion for new trial in an action brought to foreclose a mechanics lien.

Breezy Point Estates, a partnership consisting of defendants Donald Eastvold, Virginia Simms Eastvold, Darwin K. Holian, and Jerome D. Lenz, was engaged in the promotion of undeveloped land in the vicinity of Pelican Lake in Crow Wing County. In connection therewith the partners sought to purchase from defendants Arthur J.
