This case was before this court in 1882, the judgment of the district court being reversed. 13 Neb., 376. On the second trial a verdict was returned in favor of Palmer for the-sum of $758, upon which judgment was rendered. It is alleged in the petition that on the 3d day of May, 1877, the plaintiff in error purchased from the defendant certain real estate adjoining the city of Lincoln, for the sum $7,000; that $100 in cash was paid at the time of the sale, and the sum of $3,000 was to be paid in thirty days, and $3,900 in sixty days thereafter; that the plaintiff herein wholly failed to…
