This suit was brought by the plaintiff in error in the district court of Lancaster county to recover from the defendants $1,048.74 and interest, for coal sold and delivered. The plaintiff in his petition alleges:
“ First — That the plaintiff at divers times, from the 12th day of December, 1887, to the 20th day of December, 1887, furnished coal at an agreed price to the-said defend*574ants, at various points in the state of Nebraska, as directed by said defendants; that said coal was furnished at the defendants’ special instance and request, and amounted in the aggregate to the sum of $1,048.74.
