This matter is before the Court on defendant Bi-State Development Agency of *918the Missouri-Illinois Metropolitan District's ("defendant") motion to dismiss plaintiff's third amended complaint under Rule 12(b)(1), Federal Rules of Civil Procedure, for lack of standing, and Rule 12(b)(6), Fed. R. Civ. P., for failure to state a claim upon which relief can be granted. Plaintiff Scott Gustafson ("plaintiff") opposes the motion to dismiss and it is fully briefed.
