On May 31, 1939 Sylvester J. Hart and John Robert Smith filed a statement of claim in the municipal court of Chicago against Charles Gr. Evans, doing business as Evans Truck Lines, Inc., and Evans Truck Lines, Inc. On December 24, 1940 plaintiffs filed an amended two count statement of claim. Defendants filed an answer presenting defenses.
