SMITH, Justice.

This is an appeal from a judgment of involuntary dismissal granted under I.R. C.P. 41(b), in favor of respondent, and against appellant who instituted this action, seeking recovery under an alleged group life insurance contract. The trial court granted respondent’s motion for involuntary dismissal at the conclusion of the submission of appellant’s case to the court sitting with a jury.
