1. The plaintiff in error brought an action for money had and received- against her daughter-in-law, to recover $1,531, which she testified she had given to the defendant for the specific purpose of aiding in the purchase of a home to be occupied jointly by them. The defendant answered and testified that the money was given to her under an- agreement that .she would take care of and provide for the donor during the remainder of her life.
