Defendant appeals from a judgment in the district court of Henne-pin county convicting him of the crime of grand larceny. He was charged with embezzling and appropriating to his own use the sum of $4,000, the property of one Richard Winsett, placed in defendant’s hands as the agent, servant and bailee of Winsett for a specific purpose.
