In an action, inter alia, to recover damages for unjust enrichment and for money had and received, the plaintiff appeals from an order of the Supreme Court, Kings County (Hubsher, J.), dated December 22, 2004, which denied his motion for summary judgment against the defendant Eric D.W. Cohler, Inc., and granted the cross motion of the defendant Eric DW Cohler, Inc., for summary judgment dismissing the complaint insofar as asserted against it.

Ordered that the order is affirmed, with costs.
