Action by the appellee against the appellant for damages for the killing of a horse upon appellant’s railroad track. There was a demurrer to the complaint, which was overruled, and upon the filing of an answer of general denial the cause was tried by a jury, resulting in a verdict and judgment for the appellee for the value of the horse. The jury with their general verdict also returned *250answers to interrogatories. The appellant moved for a judgment notwithstanding the verdict, but the court overruled the motion, as also the appellant’s motion' for a new trial. All these rulings are properly…
