INTRODUCTION

Since this is not the first opinion in this case, the history and the facts surrounding the parties’ dispute need not be detailed at any great length. See General Insurance. Co. of America v. Clark Mall, Corp., 631 F.Supp.2d 968, 971 (N.D.Ill.2009). The case grows out of a fire at the Clark Mall, a discount mall in Chicago, at which vendors maintained kiosks from which they sold their wares.
