MEMORANDUM AND ORDER, AND REPORT AND RECOMMENDATION

I. Introduction.

Following a three-day trial of this case, the jury returned a verdict in favor of the defendant, Henry Rivera. Later, the plaintiff, Marco Rivera, filed a motion for new trial. On May 13, 2003, the court granted plaintiff a new trial on the basis that the jury’s verdict was clearly, decidedly, and overwhelmingly against the weight of the evidence.1
