This is a civil action involving the conflicting claims of the plaintiff, Joseph Plaza, and the defendants, Anthony Elak and Erances Elak, his wife, to rights in lands mutually adjacent to their respective dwellings in the City of Passaic, and there is brought here for review a judgment of the Chancery Division of the Superior Court adverse to the defendants. Defendants’ appeal was addressed to the Appellate Division of the Superior Court and while pending there was certified to us upon our own motion.
