Both parties appeal to this court, each from a portion of a judgment of the Appellate Division, third department, which reversed in part and affirmed in part a judgment of the Supreme Court for Warren county. The Appellate Division set aside findings of fact made by the trial court and made new findings. It is the duty of this court to review fhe facts found by the courts below (York Mortgage Corp. v. Clotar Construction Corp., 254 N. Y. 128), and to determine where the weight of the evidence lies (McKee v. McKee, 267 N. Y. 96, 100).
