It appears that during the month of March, 1911, the plaintiff in error, wlio is engaged in the business of selling machinery, entered into a written contract with the defendant in error, wherein it purported to lease to the city of Oeary certain machinery at a stipulated price fo be paid on delivery and monthly installments thereafter; that the total value of the personal property included in the contract was about $2,400. and, pursuant to said contract, the plaintiff delivered to the defendant the property mentioned therein, and it was installed as a part of the city…
