Ron Ayers (Claimant) and Sign Innovation (Employer) each petition for review of the adjudication of the Workers’ Compensation Appeal Board (Board) that affirmed the Workers’ Compensation Judge’s (WCJ) dismissal of Employer’s modification petition but reversed the WCJ’s award of unreasonable contest attorney’s fees. In this appeal, we consider whether an employer may seek a modification of disability benefits under the Workers’ Compensation Act (Act) 1 even though an impairment rating evaluation (IRE) reveals that the claimant is 50 percent impaired.
